PROTECTING YOUR PRIVACY Effective July 1, 2001 Revised April 1, 2005
At Community Bank of San Joaquin (the Bank) we recognize and respect the personal privacy of our customers. We strongly believe in protecting the
confidentiality and security of the information we collect about you. Because of our interest in protecting your privacy, we continue to examine our practices and those of our related companies. Community Bank has no intention
of selling your personal information to anyone. Our privacy policy describes how we treat the information we receive about you, regardless of its source.
Recognition of Your Expectation of Privacy
At Community Bank, we believe the confidentiality and protection of customer information is one of our fundamental responsibilities. We recognize that you
expect your personal information to be kept private and secure at all times. We maintain standards and procedures designed to prevent misuse of this information.
Collection, Retention and Use of Non-Public Personal Information We collect, retain, and use information about you only where we believe that it will help
administer our business or provide products, services and other opportunities to you.
We collect and retain information about you only for specific business purposes and we will tell you why we are collecting and retaining it upon your request. We use this information to protect and administer your records, loans, accounts, and funds; to comply with certain laws and regulations; to help us design or improve our products and services; and to understand your financial needs so that we can provide you with quality products and superior service. We collect the following nonpublic personal information (defined as "personally identifiable financial information") about you from a variety of sources:
- Information we receive from you, such as information on applications or other forms, which may include your name, address, social security number or
driver's license number or income and assets;
- Information about your transactions with us, our affiliates, and unaffiliated third parties, such as information about your deposit and loan account
activity or credit card usage; and
- Information from consumer reporting agencies, motor vehicle dealers, credit references, employers, and insurance companies, such as your credit history and
credit-worthiness, and information that we obtain to verify employment history or that insurance coverage is in place.
Disclosure of Non-Public Personal Information
Because we respect your privacy, we hold information about your accounts, loans and other business with us in confidence. We do not disclose
non-public personal information about you or our former customers to non-affiliated third parties, except as permitted by law. If you end your relationship with the Bank, we will continue to adhere to the information
policies and practices described in this policy.
There are instances when information about you may be provided to others. This may occur under any of the following circumstances:
- Information about you may be shared throughout the Bank when it may be necessary or helpful in handling your business or in marketing other products or
services we may offer;
- Information about you may be shared with others when it may be helpful in verifying or completing a transaction involving your account, such as one being
processed through an Automated Clearing House (ACH), Automated Teller Machine (ATM) or Point of Sale (POS) network, or when a third party (such as a merchant or another financial institution) seeks information as to whether
there are sufficient funds in your account to cover a transaction;
- We may share information with non-financial companies, including companies that perform services on our behalf, such as check printers, data processing
companies, companies that prepare account statements, or companies that help us market our own products to you or products that might be jointly offered by us and another company (as is the case with the credit card product
we offer);
- Information may be shared with independent contractors, such as technical systems consultants who modify our computer software to help us administer our
products or market our products to you;
- We may verify information about you when we are requested to do so by someone the Bank believes has a reasonable need for the information, such as when a
prospective creditor, merchant, or another financial institution seeks to confirm your deposits or loans with us;
- We may report information about your accounts to credit bureaus. Late payments, missed payments, or other defaults on your accounts may be reflected in
your credit report;
- We are required to comply with a number of laws and regulations that require us to furnish various reports to federal, state and/or local government
officials regarding certain transactions or accounts. We must also respond to judicial and administrative subpoenas and similar legal processes that require us to provide information or documents about your loans, accounts
and other business with the Bank;
- If we suspect that a crime involving you or your loan or account may have been committed, we may report our suspicions and related information to
appropriate public officials, whether or not local, state or federal laws require the Bank to do so;
- We share information with our regulatory agencies and agents of the Bank or its affiliated companies, such as our independent auditors, consultants or
attorneys, all of whom will be bound to protect the information as we do; and
- We may share information with others if you or any other person with signing authority over your account gives us oral or written permission to do so.
Maintenance of Accurate Information Community Bank has procedures that ensure that your financial information is accurate, current, and complete in accordance with commercial standards. We also
have procedures to respond to requests to correct inaccurate or incomplete information in a timely manner.
Security of Information We maintain security standards and procedures to help prevent unauthorized access to confidential information about you.
We update and test our technology to improve the protection of our information about you and to assure the integrity of our information.
When you visit our Website a "cookie" is created.
A cookie is a file that stores information about you on your computer, such as your identity and preferences when visiting our site. A cookie allows the Bank to determine when the same computer is used in a subsequent visit to our website, as well as which pages were viewed during the visit. A cookie is NOT used to identify you and will not collect personal information. You remain anonymous throughout your visit. Cookies are commonly used on web sites and do not harm your computer. You can decide if and how your computer will accept a cookie by configuring your preferences or options in your browser.
Maintaining Customer Privacy in Business Relationships with Third Parties When we do provide customer information to a third party who is assisting us in marketing or
servicing our products or services, we insist, through a confidentiality agreement, that the third party adheres to privacy principles at least as protective of your privacy as those to which the Bank adheres.
The confidentiality agreement prohibits use of personal information for any reason other than that for which it was shared.
Limitations on Employee Access to Customer Information Each of our employees has responsibility for maintaining the confidentiality of customer
information. Employees are prohibited from accessing your personal information unless there is a business reason to do so.
Internal access and sharing of information about you occurs within the Bank so that we can evaluate, structure and facilitate the services you have requested or to inform you of other financial services that may be of interest to you. We educate our employees about the importance of confidentiality and customer privacy through standard operating procedures, special training programs, and our Code of Conduct. Employees who violate these privacy responsibilities are subject to disciplinary measures.
Changes to Our Privacy Policy If, at any time in the future, we decide to share any of your personal information in a way that is inconsistent with this policy, we will give you advance notice of the
proposed change. If the change would involve sharing information without your consent, not expressly permitted by the privacy laws, you will be given an opportunity to opt out of such disclosure.
Availability of Our Privacy Policy We want you to understand how we use the information you provide to us and how committed we are to ensuring your personal privacy. Community Bank of San Joaquin will provide
